Can damp and mould affect asthma?

Damp and mould are recognised respiratory triggers and can be associated with coughing, wheezing and asthma flare-ups. The effect varies between people. Seek medical help for breathing symptoms and urgent help for a severe asthma attack.

What must a legal claim establish?

  • A relevant housing defect or hazard within the landlord's responsibility.
  • Landlord knowledge or legally sufficient notice where required.
  • A failure to respond within the applicable period.
  • Medical evidence supporting causation or material worsening.
  • Proven injury, loss or expense.

Can I claim with pre-existing asthma?

Potentially. The question may be whether the housing materially worsened the condition rather than caused asthma from nothing. Records from before, during and after exposure can help an expert distinguish the underlying condition from any additional harm.

What evidence should I collect?
