What can the Housing Ombudsman examine?
The Ombudsman considers qualifying complaints about councils and housing associations, including repair handling, communication, delay and complaint administration. The tenant normally gives the landlord an opportunity to complete its internal complaint process first.
What remedies can the Ombudsman provide?
Possible remedies include apologies, explanations, action plans, repairs, policy changes and compensation for identified service failure. The approach is not the same as calculating civil damages for breach of contract or personal injury.
What can a court decide?
A court can determine whether the landlord breached statutory, contractual or common-law duties, award damages and make orders relating to works where appropriate. Parties must follow court procedure and face potential cost consequences. The Housing Conditions Pre-Action Protocol normally applies first.
Can both routes run together?
Care is needed. Housing Ombudsman decisions show it will not investigate complaints concerning the same matters as issued court proceedings or matters already determined. A threat of possible legal action is not necessarily enough by itself, but issuing and settling proceedings can remove jurisdiction.
Which route is faster?
Neither has a guaranteed timescale. Urgent repair and safety measures should be pursued directly rather than waiting for a final complaint or trial. Court interim remedies may be available in appropriate urgent cases, while landlord and Ombudsman complaint routes can resolve service issues without litigation.
Which route costs money?
The Housing Ombudsman is free to residents. Court claims involve fees, evidence and potential costs; funding arrangements also have deductions and conditions. Ask for written funding terms and assess proportionality before proceedings.
How should I choose?
